Victoria is an experienced advocate specialising in extradition, public inquiries, regulatory and professional discipline work (particularly relating to healthcare regulation).
Practice Areas
Victoria regularly appears in extradition proceedings both at first instance and on appeal to the High Court. She is experienced in dealing with requests from Judicial Authorities from Part 1 territories, including Belgium, Ireland, Germany, Poland and Romania, and has dealt with a range of issues including forum bar, prison conditions and section 25. She has dealt with serious cases, where the underlying offences range from historic sexual abuse to murder. She brings a thorough and pragmatic approach to her work.
She is on the CPS Specialist Extradition Panel (Level 2) and worked as a Senior Crown Prosecutor with the CPS Extradition Unit on secondment in 2020-2021 during the UK’s exit from the European Union and the introduction of the Trade and Co-operation Agreement.
Notable Cases:
- Lankiewicz v Poland [2022] 5 WLUK 118. Appeared for the Judicial Authority at both the High Court and lower court. The concepts of fugitive status and ‘Brexit uncertainty’ were key issues in the appeal. Secured an order for extradition, which was upheld on appeal.
- Ireland v M. Secured a discharge acting for a father of a severely disabled child sought by Ireland in respect of benefit fraud
- Ireland v JM. Secured extradition in respect of allegations of historic sexual abuse.
- Belgium v A. Secured an order for extradition in respect of allegations of people trafficking offences.
- M v Poland. Appeared for the Judicial Authority at both the High Court and lower court. Secured an order for extradition, which was upheld on appeal.
Victoria has worked in this area since 2017 and regularly acts for the Nursing and Midwifery Council and the General Dental Counsel. She also has experience in proceedings before the UKCP and the General Optical Council.
Victoria has substantial experience in dealing with extremely serious matters, including cases involving sensitive fact patterns, sexual misconduct and misconduct set against the background of patient death. She has also dealt with multi-Registrant proceedings.
Victoria has also written practice notes for Lexis Nexis covering a number of different fitness to practise proceedings.
Notable Cases:
- GDC v A . Acted for the Regulator. Allegations of sexual misconduct found proved and a sanction imposed.
- NMC v TR. Acted for the Regulator in a lengthy hearing spanning several weeks, concerning allegations of unsafe midwifery practices which were locally widespread. Set against the background of a baby death.
- NMC v W. Acted for the regulator against a forensic nurse in a case involving the death of a detained person in police custody.
- NMC v N. Acted for the regulator in a case in which a senior nurse was dishonestly claiming extra income over a lengthy period of time.
- NMC v G. Acted for the regulator in a case which involved 500 particularised instances of alleged misconduct.
Victoria has worked on some of the most serious and high-profile statutory inquiries since 2018 including the Covid-19 Inquiry (Victoria has been appointed Junior Counsel to the inquiry), and the Undercover Policing Inquiry (as second junior counsel to the inquiry on Tranche 2).
