Tomas McGarvey’s client acquitted of rape, ABH and threats to kill.

Tomas McGarvey, instructed by Nicola Hall of Tuckers Solicitors, acted for R who faced six charges of rape, two charges of assault occasioning actual bodily harm, and one charge of making threats to kill. R was accused of assaulting and making threats to kill the first complainant, and a campaign of rape against the second complainant.

The first trial listing in 2022 was unable to proceed due to significant disclosure issues which arose from a contested section 8 application heard shortly before the trial. The case involved the use of a police sexual offences liaison officer who, as a result of disclosure requests and cross-examination regarding improper behaviour was removed from the case during the trial.

The jury convicted R of one count of assault and acquitted him of the remaining counts on the indictment following an 11 day trial at Maidstone Crown Court . R was later sentenced to a community order and an application for a post-acquittal restraining order was successfully resisted.
