Tomas McGarvey, instructed by Paul O’Donnell of Imran Khan and Partners, has successfully persuaded the Crown Prosecution Service (CPS) to offer no evidence against his client. Tomas’s client, a young man charged with several counts of possession with intent to supply Class A drugs was due to have a trial with his three co-defendants in December 2021. Tomas successfully applied to sever his client’s case and sought to rely on the defence provided at section 45 of the Modern Slavery Act 2015.
Tomas advised on the instruction of several experts including an expert in criminal exploitation and a psychologist with specific expertise in relation to suggestibility. The expert reports were served on the CPS and Tomas made representations that the CPS ought not to proceed against his client. Following consideration of the expert reports and the representations, the CPS agreed to offer no evidence on all counts faced by Tomas’s client.
