Stan Reiz KC successfully defends 69 year old acquitted of murder by reason of loss of control

R attended a police station and confessed to unlawfully killing his wife. He said he lost control and strangled her to death. R pleaded guilty to manslaughter at an early stage, but the plea was not accepted by the prosecution who proceeded to trial on the charge of murder.

At trial, R relied upon police records and psychiatric evidence in support of his case that he had suffered psychological harm due to chronic domestic abuse during the 38 year marriage. Based on his account, he was diagnosed with battered spouse syndrome. R said in evidence that on the day of the incident, his wife abused him and told him he was not the biological father of their son. It was this claim which triggered his loss of control.  

Following 2 hours of deliberations, the jury unanimously acquitted R of murder. He was sentenced to 6 years imprisonment for the offence of manslaughter by reason of loss of control.
