Molly Dyas, instructed by Carly Pharoah of JSP Solicitors, successfully represented a Youth charged with being concerned in the supply of Class A drugs.
Due to significant disclosure failings by the prosecution, including the provision of key telephone evidence days before trial, Molly made an argument to exclude the evidence under s78 of PACE 1984, relying on the case of Boardman [2015] EWCA Crim 175.
Following extensive legal argument, the Judge decided to exclude almost the entirety of the prosecution case under s78. The prosecution offered no evidence to the charges.
