Jim Sturman QC in successful challenge to a POCA 2002 Moratorium Order
Jim Sturman QC, instructed by Matthew Bosworth of Russell-Cooke, successfully overturned a Moratorium Extension Order granted under section 336A of POCA 2002.
The effect of the Order was that it had frozen nearly £3,000,000 of a company’s funds. Following multiple attempts to engage with the prosecuting authority the Order was challenged for breach of procedural requirements, lack of full and frank disclosure to the Judge granting the original Order and because of a failure to exercise due diligence in the investigation. The Judge that had made the original Order heard the objections and set the Moratorium aside.
