Profile

General Crime

Predominantly defence practice spanning the full range of criminal conduct including violence, drugs, sex and firearms. Experience in complex and multi handed cases including organised crime. Particular interest in defending young persons; frequently appears for youths charged with gang-related offences such as conspiracy to supply, possession of firearms, and serious violence; also continues to accept instructions for more complicated matters in the Youth Court.

Fraud

Has quickly gained a wealth of experience in a wide range of fraud, money laundering and other dishonesty matters, including confiscation, acting both alone and as junior to leading counsel. Frequently instructed in complex and sensitive cases.  Experienced in the international aspects of multi-jurisdictional investigations including where Mutual Legal Assistance has been sought and where prosecutions have taken place in more than one country. Recently acted  for the first defendant in “Imperial Consolidated”, an alleged $250 million offshore "Ponzi" scheme of which the defendant was acquitted following two lengthy trials over three years. Acted for the Liberal Democrats’ largest donor Michael Brown, alleged to have defrauded the former Manchester United Chairman of over $10 million. Experience of insolvency law in both criminal and civil contexts including prosecutions by BERR and acting on behalf of a trustee in bankruptcy. In addition to defence work, previous instructions include from the Serious Fraud Office to undertake a review of FBI/Grand Jury material where the UK trial was preceded by convictions in the US Federal Court.

Health and Safety , Fire Safety and Regulatory  

Acts in a variety of Health and Safety and regulatory proceedings, including CPS/HSE joint investigations. Acts for both prosecution and defence in relation to allegations of gross negligence manslaughter and Health and Safety offences, recently acted in a double manslaughter prosecution arising out of the explosion of a Sussex fireworks factory in which two firemen were killed. Previous cases include gross negligence manslaughter arising out of a medication error in a care home.  Significant expertise in fire-related matters and proceedings brought under the Regulatory Reform (Fire Safety) Order, prosecuting for the Fire and Rescue Service and advising companies and individuals as to compliance with the same.

Regulatory and Disciplinary

Experienced in regulatory and disciplinary proceedings. Has acted for health care professionals, including before the General Optical Council, and for doctors, including Coroners Court hearings where their conduct has been called into question. Experienced in matters concerning the Commission for Social Care Inspection including appeals against their findings to the Care Standards Tribunal.

Inquests

Acts for interested parties at Coroner’s inquests. Has represented doctors whose conduct has been called into question, including regarding matters such as undiagnosed DVTs and a terminal care medication error.

Road Traffic Law

Frequently instructed to defend high profile and “celebrity” clients in relation to Road Traffic offences, also acts for corporate clients facing prosecution by the Vehicle and Operator Services Agency (VOSA).

R v Michael Brown Appeared for Defence
(Junior Counsel) Trial of the absent financier and Liberal Democrat donor accused of obtaining $10 million by deception from former Manchester United Chairman Martin Edwards. The jury were discharged from reaching a verdict in relation to the main count.

R v 'X' Appeared for Respondent
5 day appeal against conviction in which the 17 year old appellant sought to overturn his conviction for obtaining over £13,000 by deception via false trades on the website eBay. Unusually, expert computing evidence was called to link the ownership of Internet Protocol addresses recorded by eBay to the appellant’s location and computer usage abroad.

R v R Successful prosecution of £500 million multi-jurisdictional metals trading fraud involving complicated international disclosure issues.

SFO v Jared Brook Massive offshore alleged Ponzi conspiracy, whereby the defendants were alleged fraudulently to have received over £250 million from five continents over four years. After two trials and one interlocutory appeal lasting a total of fifteen months, the defendant was acquitted of all counts.

R v W and Others Appeared for Prosecution
Currently instructed in prosecution for double gross negligence manslaughter and Health and Safety At Work Offences arising out of a fireworks factory explosion.

R v Hooper and Dixon Appeared for Defence (Junior Counsel )
First-ever prosecution of the owner of a care home for gross negligence manslaughter, following a medication error by a care assistant. Issues included regulatory matters concerning the home’s compliance with CSCI and national minimum standards, and complicated medico-legal issues arising regarding as to cause of death (deep vein thrombosis). The Crown offered no evidence two weeks into trial.

Miscellaneous Crime
R v X Appeared for Defence
15 year old charged with commercial supply of heroin/crack cocaine. Defence of plant. Case was dismissed following defence cross-examination of Police Officers regarding stop and search powers and conduct of a strip search. After defence submissions, the District Judge ruled the drugs inadmissible on the basis of serious and substantial breaches of PACE codes.

R v Alikaj Appeared for Prosecution
Large scale commercial theft with losses exceeding £90,000. Proceedings encompassed lengthy abuse of process hearing on Ebrahim principles in respect of missing CCTV footage.

R v 'X' Appeared for Defence
15 year old charged with ABH against the Deputy Headmaster of his school, the incident having occurred during a lesson. Third party disclosure of the details of pupils present was sought from the school, 4 of whom were witness summonsed and gave evidence for the defence via video link. The defendant was acquitted.
