Finding in favour of the interested party, this is the first case in which the Administrative Court has confirmed that proceedings under the Proceeds of Crime Act 2002 can be stayed as an abuse on the grounds of ‘unfairness’.

Represented the first of 12 defendants, all allegedly members of a notorious London street gang who had attacked and killed a member of a rival gang. Tried over an 8 week period at the Old Bailey. Complex issues relating to blood spatter – of huge significance to the first defendant, said on that basis to be the person responsible for the fatal stab wound. Much work done on the science – leading to a successful half time submission on murder/manslaughter and eventual acquittal by the jury in respect of the remaining public order count.
