Text  Ian Stern QC leading Gelaga King and Kieran Galvin (led junior) defended the two principals of Future Network Systems, a computer reseller and software company that went into liquidation in 2003. The defendants faced allegations of conspiracy to defraud Hewlett Packard and others and two counts of fraudulent trading, with the alleged losses running into several million pounds. The trial was listed for hearing over four weeks at Southwark Crown Court. The case involved complex contractual issues in relation to the commercial sale of computer hardware. Following the Crown’s inability to provide important material from Hewlett Packard it was argued on behalf of the defendants that this amounted to an abuse of process. Following a four day legal argument the trial was stayed.
